This Payment and Refund Policy ("Policy") governs the payment terms, subscription fees, and refund conditions applicable to users of LocalStar ("Platform"), including but not limited to brand owners, influencers, and artists (collectively, "Users"). By accessing or using LocalStar, Users agree to comply with the terms set forth herein.
1. PAYMENT TERMS
1.1 Subscription Fees for Influencers and Artists
- Influencers and artists may create profiles on the Platform at no cost. However, to access additional promotional benefits, including enhanced visibility, increased content uploads, and additional platform features, they may opt for a paid subscription plan.
- The subscription fees, pricing tiers, and associated benefits shall be displayed on the Platform and may be revised at the sole discretion of LocalStar.
- Subscription fees are payable in advance and shall be non-refundable, subject to the provisions of Section 3 (Refund Policy).
- The subscription shall be valid for the duration specified at the time of payment. Users may opt to renew their subscription before expiration.
1.2 Payment for Brand Owners
- Brand owners may browse and connect with influencers and artists on the Platform at no charge.
- When booking an influencer or artist for an event, advertisement, or brand promotion, brand owners shall be required to make full payment at the time of booking.
- The fee payable for each engagement shall be determined by the influencer or artist and displayed on the Platform before finalizing the booking.
- Payments shall be processed through the Platform’s designated payment gateway, and Users agree to abide by the terms and conditions of such third-party payment service providers.
2. TRANSACTION PROCESSING
- All payments made via the Platform shall be securely processed using a third-party payment gateway. LocalStar does not store any payment-related data such as credit card or banking details.
- Users shall be responsible for ensuring that their payment information is accurate and up to date.
- Any additional transaction fees, including but not limited to service charges and currency conversion fees, shall be borne by the User.
- In the event of a failed or declined payment, the booking or subscription may not be processed, and the Platform shall not be held liable for any loss arising therefrom.
3. REFUND POLICY
3.1 Subscription Fees (Influencers and Artists)
- Subscription fees paid by influencers and artists for enhanced visibility and additional platform features are strictly non-refundable.
- No refund requests shall be entertained, including but not limited to cases where the User discontinues the use of the Platform before the expiration of the subscription period.
3.2 Payments by Brand Owners
- Payments made by brand owners for booking an influencer or artist shall be refundable only in cases where the booked influencer or artist fails to appear for the scheduled event.
- To claim a refund, brand owners must submit a written request to LocalStar, along with valid proof of non-appearance, within seven (7) days from the scheduled event date.
- Upon verification, LocalStar shall process the refund within a reasonable time frame, subject to deductions for transaction fees, if applicable.
- Refunds shall be credited through the same mode of payment used during the original transaction.
4. LIMITATION OF LIABILITY
- LocalStar is a technology-driven marketplace that facilitates connections between brand owners and influencers/artists. The Platform merely provides a booking and engagement platform and does not guarantee the performance, professionalism, or reliability of any User.
- LocalStar shall not be held liable for any disputes, cancellations, no-shows, delays, misrepresentations, or other non-performance by either the brand owner or the influencer/artist.
- All commercial transactions, including but not limited to negotiations, bookings, and payment terms, are solely between the brand owners and influencers/artists. Any claims arising from such transactions must be resolved directly between the concerned parties.
- LocalStar shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of the Platform.
5. MODIFICATIONS TO THE POLICY
LocalStar reserves the right to amend, update, or modify this Policy at any time without prior notice. Users are encouraged to review this Policy periodically to stay informed of any changes. Continued use of the Platform after any modifications shall constitute acceptance of the revised Policy.
